Oleg acted in a workplace safety and insurance appeal involving whether sales contractors for a promotional merchandise business should be classified as workers or independent operators.
This matter involved the classification of sales contractors under Ontario’s workplace safety and insurance regime. The Tribunal considered the practical reality of the working relationship, including control, business expenses, scheduling, client relationships, invoicing, and the contractors’ ability to operate independently. The decision confirmed that the actual relationship between the parties can be more important than the wording of a written contract alone.

The appeal was allowed, and the sales contractors were found to be independent operators rather than workers for the relevant audit year and subsequent years.
Oleg acted for the defendant/moving party in a real property and commercial litigation matter involving a vendor-take-back mortgage, an assigned agreement of purchase and sale, and a claim for the unpaid balance of a mortgage connected to a property transaction.
This matter involved a dispute over whether a party could be held liable for the unpaid balance of a vendor-take-back mortgage after an agreement of purchase and sale had been assigned. Oleg acted for the defendant/moving party. The court considered the sealed contract rule, the effect of assignment and novation, and whether the pleadings disclosed a reasonable cause of action. The claim against Oleg’s client was dismissed, with costs awarded to that defendant.
