Martin v. Hurst, 2022 ONSC 3877
The court reviewed the liability and damages issues, including what compensation could be assessed if liability was established. Compensation was not awarded at that stage; the motion was dismissed, with the injured person given the option to continue the claim through a shorter undefended trial process.
The case involved settlement funds connected to a former client’s resolved legal matter. A former lawyer sought a court order giving him a claim over those funds for alleged unpaid legal fees.
This matter reflects Kate’s broader litigation experience with disputes involving settlement funds, legal fee claims, and post-settlement court proceedings.
