Joshua acted for a plaintiff seeking to protect her interest in a property after a disputed transfer following mortgage enforcement proceedings.
The case involved a motion for leave to register a certificate of pending litigation against a Hamilton property. The plaintiff alleged that the transfer of the property was fraudulent and void as against her. The court found there was a triable issue and granted the relief sought.

The court granted leave to register a certificate of pending litigation against the property, allowing the plaintiff’s claim to continue while protecting the disputed property interest.
Joshua acted in an appeal involving whether a claim could be amended to correct the name of a defendant after the limitation period had expired.
The case considered whether the intended defendant knew, before the limitation period expired, that it was the party the plaintiff intended to sue. The Court of Appeal allowed the correction, confirming that an amendment may be permitted where the wrong name was used but the intended party had sufficient knowledge of the claim.
